Supreme Court Advocates for Childcare and Feeding Rooms in Public Spaces The Supreme Court of India has suggested that the Union Government develop a comprehensive policy addressing the construction of feeding rooms and childcare facilities  in public places. This move aims to ensure that nursing mothers and their children can access basic amenities in a dignified and private manner, reinforcing their fundamental rights under the Indian Constitution. SC Encourages Policy Formulation A bench comprising Justice BV Nagarathna  and Justice N Kotiswar Singh  highlighted the absence of a structured framework to address this pressing issue. The court advised the Centre to propose a policy that could then be implemented across the states, scheduling the next hearing for December 10, 2024.   The apex court emphasized that before issuing formal directions, it was crucial to understand the Centre’s perspective on implementing the petitioner’s demand for childcare and feedi...

Panel Recommends Action Against JJB Members for Lapses in Granting Bail in Pune Car Crash Case

Panel Recommends Action Against JJB Members for

Lapses in Granting Bail in Pune Car Crash Case

A panel from the Women and Child Development (WCD) Department of the Maharashtra government has recommended disciplinary action against two Juvenile Justice Board (JJB) members for "procedural lapses" in granting bail to the minor accused in the Pune Porsche crash case.

Investigation and Findings

Prashant Narnaware, the Women and Child Development Commissioner, confirmed that the final report has been submitted to the Maharashtra government. The report, resulting from a thorough investigation and responses to show cause notices given to the JJB members, recommends disciplinary action against the two state-appointed JJB members for their procedural mishandling.

Details of the Incident

The case stems from a tragic incident on May 19, when a Porsche car, allegedly driven by a minor in an inebriated condition, struck and killed two IT professionals in Pune's Kalyani Nagar area. The lenient bail conditions granted to the minor, including writing a 300-word essay on road safety, caused a nationwide uproar. This prompted the WCD Department to form a panel to investigate the conduct of the JJB members in granting bail to the minor.

Bail Conditions and Court Rulings

As part of his bail conditions, the minor was required to write an essay on road safety, emphasizing responsible driving and the repercussions of reckless behavior. Earlier this month, the 17-year-old accused submitted the essay as part of his bail conditions. He was released from an observation home last month after the Bombay High Court ruled that his remand orders were illegal.

Police and Legal Actions

Pune Police Commissioner Amitesh Kumar assured on June 26 that legal action would be taken against all the accused involved in the Pune car accident. "As far as the case is concerned, the investigation is being done as per the evidence which is received. We will ensure that legal action is taken against all," Kumar stated.

On June 21, the Pune district court granted bail to Vishal Agarwal, the father of the accused teenager, in the primary case where he was booked under Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015.

Conclusion

The panel's recommendation for disciplinary action highlights the importance of procedural integrity in the judicial process, especially in cases involving minors and serious offenses. The Pune Porsche crash case has underscored the need for stringent and transparent legal proceedings to ensure justice and maintain public trust.
