Bar Council of India Removes 107 Fake Advocates from  Delhi Roll to Uphold Legal Integrity The Bar Council of India (BCI) has taken decisive action in a sweeping initiative aimed at maintaining the integrity of the legal profession by removing 107 fake advocates  from the Roll of Advocates in Delhi  between 2019 and October 2024. This step comes as part of the BCI's rigorous verification process to ensure that only qualified, genuinely practising advocates remain in the profession, ultimately upholding public trust in the legal system. Strengthened Verification Framework Under Rule 32 This effort falls under Rule 32 of the Bar Council of India Certificate and Place of Practice (Verification) Rules, 2015 . In a significant ruling, the Bombay High Court on Tuesday directed the immediate release of a 17-year-old boy, who was allegedly involved in the Pune car accident, from the observation home. The minor had been held at the Juvenile Justice Board's observation home for 36 days following the incident. 


Overview of the Incident


The tragic accident in Pune resulted in the loss of two innocent lives, sparking a public outcry and leading to the juvenile's detention. However, the court ruled that the orders remanding him to the observation home were illegal. The court emphasized the importance of adhering to juvenile justice laws, which prioritize the rehabilitation and social integration of juvenile offenders over punitive measures.


High Court's Ruling


The division bench of Justices Bharati Dangre and Manjusha Deshpande emphasized that justice must prevail regardless of public pressure or the severity of the situation. The court criticized the police for their handling of the case, stating that law enforcement had succumbed to public pressure instead of following legal protocols.


In its order, the court stated, "Though the manner in which the entire situation has been handled by the respondents including the investigation wing, we can only express our dismay and perturbation by describing the whole approach as an unfortunate incident and hope and trust that the future course of action to be chartered, shall be in accordance with existing provisions of law, avoiding any haste."


Importance of the Rule of Law


The court underscored the principle that the rule of law must prevail in every situation. Quoting Martin Luther King, the court noted, "Injustice anywhere is a threat to justice everywhere." The judges stressed their obligation to implement the law as it stands, highlighting the Juvenile Justice Act's focus on rehabilitation.


Release and Rehabilitation


The High Court issued a writ of Habeas Corpus for the release of the juvenile from the observation home, where he had been detained despite being granted bail. The court quashed the orders that had authorized his continued detention, deeming them illegal and without jurisdiction.


The court also mandated that the minor should continue to undergo any necessary therapy or sessions he had started during his detention. These sessions, including those with a psychologist or at a de-addiction center, should continue while the minor resides at home or a safe place, under the supervision of his paternal aunt.


Case Against Vishal Agarwal


In a related development, the Pune district court granted bail to Vishal Agarwal, the father of the accused teenager. Agarwal had been booked under Section 75 of the Juvenile Justice Act for allegedly forcing the driver to take responsibility for the crime on behalf of his grandson.
