Supreme Court Advocates for Childcare and Feeding Rooms in Public Spaces The Supreme Court of India has suggested that the Union Government develop a comprehensive policy addressing the construction of feeding rooms and childcare facilities  in public places. This move aims to ensure that nursing mothers and their children can access basic amenities in a dignified and private manner, reinforcing their fundamental rights under the Indian Constitution. SC Encourages Policy Formulation A bench comprising Justice BV Nagarathna  and Justice N Kotiswar Singh  highlighted the absence of a structured framework to address this pressing issue. The court advised the Centre to propose a policy that could then be implemented across the states, scheduling the next hearing for December 10, 2024.   The apex court emphasized that before issuing formal directions, it was crucial to understand the Centre’s perspective on implementing the petitioner’s demand for childcare and feedi...

Congress Leader Chidambaram Vows to Implement "Bail is the Rule, Jail is the Exception" Principle if INDIA Bloc Comes to Power

Former Union Minister and Congress leader P Chidambaram made significant promises on Sunday, stating that if the INDIA bloc comes to power at the Centre, it would enact a special law to operationalize the legal principle established by the Supreme Court: "bail is the rule, and jail is the exception."

Enacting New Legislation

Chidambaram emphasized the need for a special law to ensure that bail is granted as a rule, especially highlighting the plight of undertrial prisoners, a majority of whom belong to marginalized communities. He underscored the importance of implementing this principle effectively in lower courts, where it is often overlooked.

Repealing Controversial Laws

In addition to promising to implement the "bail is the rule" principle, Chidambaram stated that the INDIA bloc would repeal several contentious laws enacted by the BJP government, including the Citizenship Amendment Act (CAA) and three criminal laws. He emphasized the need to review and amend laws that are not in line with constitutional principles.

Addressing Allegations and Clarifications

Chidambaram responded to allegations by CPI (M) leaders that Congress had been silent on the CAA issue. He highlighted instances where Congress leaders, including Shashi Tharoor and Priyanka Gandhi, had voiced opposition to the CAA. He clarified Congress's stance on the matter, refuting claims of silence or inaction.

Electoral Manifesto Commitments

The Congress manifesto for the 2024 Lok Sabha elections pledges to review and change all anti-people laws passed by the BJP/NDA government without proper parliamentary scrutiny and debate. This commitment aligns with the party's promise to reverse the damage caused by controversial legislation affecting various sectors, including workers, farmers, criminal justice, environment and forests, and digital data protection.

Criticism and Concerns

The Citizenship Amendment Act (CAA) has faced criticism for its provisions, which grant citizenship based on religious criteria, potentially undermining the secular fabric of the Indian Constitution. Critics argue that the law discriminates against Muslims and violates the principles of equality and secularism.

Conclusion

Chidambaram's statements reflect the Congress party's commitment to legal and judicial reforms aimed at ensuring justice, fairness, and inclusivity for all citizens. The promises made by the party regarding bail laws and the repeal of controversial legislation will likely shape the discourse in the upcoming elections, with implications for India's legal and social landscape.
